MyTapTour

1. Acceptance of Terms

By downloading, installing, or using MyTapTour ("the app"), you agree to be bound by these Terms of Service. If you do not agree, do not use the app.

2. Description of Service

MyTapTour is a mobile application that enables users to participate in NFC-based scavenger hunts and tours. Users scan physical NFC tags at various locations to earn rewards, track progress, and complete tour stages. Tour operators can create and manage tours through the MyTapTour admin portal.

3. Account Registration

To use MyTapTour, you must create an account using email/password, Google Sign-In, or Sign in with Apple. You are responsible for:

• Providing accurate account information
• Maintaining the security of your account credentials
• All activity that occurs under your account

You may delete your account at any time from the app's Settings page.

4. Paid Tours

Purchases

Some tours require a one-time purchase. Prices are displayed before you buy. Payments are processed securely by Stripe. By completing a purchase, you agree to pay the listed price.

Refunds

Refund requests are handled on a case-by-case basis. If you believe a purchase was made in error or the tour was not as described, contact us at hello@mytaptour.com within 14 days of purchase.

No Resale

Tour access is tied to your account and is non-transferable. You may not resell, share, or redistribute access to paid tours.

5. User Conduct

When using MyTapTour, you agree not to:

• Tamper with, clone, or counterfeit NFC tags
• Use automated tools or scripts to simulate tag scans
• Attempt to gain unauthorized access to other users' accounts or data
• Interfere with the operation of the app or its infrastructure
• Use the app for any unlawful purpose
• Fraudulently redeem rewards or exploit tour mechanics

We reserve the right to suspend or terminate accounts that violate these terms.

6. Rewards

Rewards (coupons, points, clues) are provided by tour operators, not by MyTapTour. Reward availability, terms, and redemption conditions are set by the tour operator. MyTapTour is not responsible for:

• The value or availability of rewards
• A business's refusal to honor a reward
• Changes to reward terms by the tour operator

7. Tour Operators

Tour operators who create content on MyTapTour are responsible for:

• The accuracy of tour descriptions and tag placements
• Honoring rewards they create
• Obtaining necessary permissions for tag placement at locations
• Compliance with local laws and regulations

8. Intellectual Property

The MyTapTour app, its design, code, and branding are owned by Next Dimension LLC. Tour content (descriptions, images, rewards) is owned by respective tour operators. You may not copy, modify, or distribute any part of the app without permission.

9. Location Services

The app uses your device's location to display nearby tours and calculate distances. Location access is optional but some features may be limited without it. You can revoke location access at any time through your device settings.

10. Disclaimer of Warranties

MyTapTour is provided "as is" without warranties of any kind. We do not guarantee that:

• The app will be available at all times without interruption
• NFC tags will always be accessible or functional at their locations
• Tour content is accurate or up to date
• Rewards will be honored by third-party businesses

11. Limitation of Liability

To the maximum extent permitted by law, Next Dimension LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the app, including but not limited to loss of data, loss of profits, or personal injury while participating in tours.

12. Safety

When participating in tours, you are responsible for your own safety. Always be aware of your surroundings, follow local traffic and safety laws, and do not trespass on private property to reach tag locations. MyTapTour is not responsible for injuries or incidents that occur while using the app.

13. Termination

We may suspend or terminate your access to MyTapTour at any time for violation of these terms or for any other reason at our discretion. You may stop using the app and delete your account at any time.

14. Changes to Terms

We may update these Terms of Service from time to time. Continued use of the app after changes constitutes acceptance of the updated terms. We will notify you of significant changes through the app.

15. Governing Law

These terms are governed by the laws of the State of Connecticut, United States, without regard to conflict of law provisions.
